A Favor Delivery driver is accused of brandishing a handgun at a teenage client last year, saying “You wouldn’t like it if someone rushed you, would you?” according to court documents.

Austin police have charged the driver, identified in an arrest affidavit as 29-year-old Thomas Alexander Gray, with aggravated assault with a deadly weapon.

A 16-year-old working at the Texas Rowing Center near downtown Austin on Lady Bird Lake had ordered food through the Favor app for an upcoming afternoon break on Sept. 8, 2019, the affidavit said.

As the teen’s break time approached, he told police, he used the app to check on the status of his food. He texted the driver, “Where are you” — the driver responded “What up.” He texted again, “Are you close” and got a thumbs-up emoji for a reply.

More time passed, and the teen sent another message: “Why does the time keep getting longer it was supposed to be 3:54 the 4:05 the 4:08 now it’s 4:11,” the affidavit said.

A short while later, the driver notified the teen that he had his food and the two met in the parking lot of the rowing center.

The teen told police that driver had a black pistol in his lap, raised the gun with one hand and loaded a magazine into it with his other hand. According to the affidavit, the driver cocked the pistol “and then began waving the gun around while pointing it in the general direction” of the teen.

The driver told the teen, “You wouldn’t like it if someone rushed you, would you?” and “You really shouldn’t rush people because it might ruin their day,” the affidavit said.

The driver placed the gun in a red bag, handed the teen his food and drove away, according to the affidavit.

Austin police contacted Favor and confirmed Gray to be the driver, the affidavit said. Gray’s Nevada drivers license photo also matched the teen’s description of the man who brandished the gun at him, police said.

Gray was in the Travis County Correctional Complex on Tuesday with bail set at $30,000, jail records show.
