A man accused in the fatal shooting of Jason Sean Robinson, 39, in Cedar Park was involved in a fight with Robinson about Robinson’s girlfriend, according to an arrest affidavit.

Kelly Lawrence Schernik, 35, was charged with first-degree murder after Robinson died from his wounds at a hospital on March 25, police said. The felony is punishable by up to 99 years in prison.

Cedar Park police were notified about the shooting at a home in the 2100 block of Bindon Drive at 5:45 a.m. on March 22, the affidavit said.

It said the homeowner, Ilana Tanner, told police that Schernik had shot Robinson, who was her boyfriend.

Tanner said Robinson lived with her and they had a party at their house on the night of March 21 with several people, including Schernik, police said.

Tanner said she and Schernik left the house at 11 p.m. and went to another friend’s house while Robinson stayed at the home, the affidavit said.

It said Tanner told police that Schernik showed her friend two guns that he carried in his backpack. The two guns were a small pocket-style handgun and a revolver, the document said.

Tanner and Schernik returned back to Schernik’s and Robinson’s home at 3:30 a.m. March 22 and went into a guest bedroom where they fell asleep, according to the affidavit.

It said Robinson woke up at 5 a.m. and came into the guest bedroom yelling at Schernik to get out. Robinson was holding a small handgun but did not point it at anyone, the affidavit said.

Tanner told police she kept telling Robinson that she and Schernik didn’t “hook up” as Schernik was packing his bag to leave, according to the affidavit.

It said when Schernik couldn’t find his shoes, Robinson told him that Robinson had thrown the shoes in the bushes in the front yard.

Tanner said she went into the front yard to look for the shoes while Schernik and Robinson continued to argue in the entryway inside the house, the affidavit said. It said Tanner told police she heard five gunshots and saw Schernik run to his vehicle.

She said she went inside the house where Robinson told her that Schernik had shot him and to call 911, police said. Tanner called 911 and performed lifesaving measures until paramedics arrived, the affidavit said. Robinson later died at a hospital.

The affidavit said police later found six .40 caliber shell casings in the entryway of the home. Surveillance video from the camera outside the home’s front door showed Schernik at 5:39 a.m. standing on the front porch and leaning inside the house while holding what appeared to be a gun in his left hand, police said.

The video showed Schernik pointing the gun inside the house and then walking away, the affidavit said. It said police arrested Schernik on March 22 during a traffic stop outside his Georgetown home.

Schernik declined to speak to police, the affidavit said. He was being held at the Travis County Jail on Tuesday with bail set at $350,000.
