AUSTIN (KXAN) — Three people were critically injured after a pickup truck struck them and several other pedestrians on Oct. 31 at a Raising Cane’s in downtown Austin. One other person was injured in the crash, according to an arrest warrant affidavit.

Police arrested 21-year-old Antonia G. Garcia Rios at the scene. According to officers, Rios was allegedly driving the Ford F-150 pickup truck at the time of the crash. She was charged on two counts of intoxication assault charges.

The affidavit provided more details on what led up to the crash. Rios allegedly told police that she and other friends were picked up “after bar hopping” on East Sixth Street downtown.

The friend driving the pickup truck was in the drive-thru lane at Raising Cane’s when they needed to use the restroom, according to the affidavit. That friend then got out of the pickup truck and walked into Raising Cane’s. That’s when Rios allegedly got into the driver’s seat of the pickup truck, court records said.

The friend who was originally driving had the key on them when officers arrived. That means “the transmission would not drive” while they were in the building, according to the affidavit. When the engine restarted in the pickup, Rios “started driving forward.”

“Video footage shows the F150 jerk quickly forward and drive onto the sidewalk to the driver side of the vehicle,” court records said.

According to the affidavit, “several pedestrians were standing on the sidewalk” and that is when the pickup truck “ran over them.”

A total of four people were taken to the hospital, and three were “in critical condition” at the time, court records said. In a previous release from APD, it indicated five people were injured at the time.

No other details were available Monday.
