Texas House panel subpoenas death row inmate Robert Roberson a second time

AUSTIN (KXAN) — Texas Attorney General Ken Paxton announced a new motion filed Thursday in hopes of keeping death row inmate, Robert Roberson, from testifying in front of a state House committee hearing, Paxton’s office said in a news release.

Paxton filed for a motion to prevent a “procedurally deficient and overly burdensome subpoena” from allowing Roberson to testify. Roberson is scheduled to testify at the Texas Capitol Friday, Dec. 20.


Texas House panel subpoenas death row inmate Robert Roberson a second time

Roberson was convicted of capital murder in 2002 for the death of his 2-year-old daughter, who was diagnosed with shaken baby syndrome. Roberson was scheduled to be executed earlier this year, amid concerns over the validity of his conviction. In the latest subpoena, Texas lawmakers said Roberson should be allowed to provide testimony at the Capitol regarding that conviction, which some legislators said was based on “junk science,” The Texas Tribune reported.

In the release Thursday, Paxton argued the latest subpoena was invalid because of “serious security risks.” The filing also claims the subpoena wasn’t issued properly by the committee and violated the Open Meetings Act.
